Gaijin Community Guidelines: Common Rules

These Community Guidelines ("Guidelines") outline the basic rules of behavior on Gaijin’s websites (including Gaijin official forums related to its Games, called "Forum" in the Guidelines), official social media resources, and other Services where you, a User, may post your commentaries and other content related to the Gaijin Games (collectively - ("Gaijin’s Websites").
All the provisions of these Guidelines are consistent with the Terms and Conditions, including the Terms of Service and Privacy Policy, and unconditionally binding for you. By creating a Gaijin Account or using Gaijin's Websites, the User agrees to all terms and conditions hereof in full without any exceptions. You may not use Gaijin's Websites if you are not willing or able to be bound by the terms of these Guidelines.
The capitalized terms (words) not defined herein, shall be interpreted as provided by EULA and Terms of Service.
All the terms and conditions of these Guidelines apply to every Gaijin's Website regardless of the official language of such Gaijin's Website. Some of the Gaijin's Websites may establish rules themselves, and these rules are obligatory for the Users of such websites whereas they do not contradict these Guidelines (for instance, Appendices No. 1-3 to these Guidelines listed below). For the avoidance of doubt, if such rules on any of Gaijin's Websites contradict these Guidelines, the latter should prevail without question.
Attention! The Forum is intended for player communication and should not be considered a way to seek official support unless otherwise is expressly provided by these Guidelines. Please see paragraph 6 for Gaijin Support Service contact details.

1. KEY TERMS
1.1. Forum
The Forum is a public place on the Internet where the Users may communicate with each other and share their commentaries, views, content, and other information concerning War Thunder, Crossout, Star Conflict, CRSED: F.O.A.D., Enlisted and other Games published by Gaijin and referred to as the ("Game(-s)" in the Terms of Service. The Forum is primarily based on the content generated by Users (please also see paragraph 2.10 of these Guidelines).
The Forum is usually divided into sub-forums or sub-sections devoted entirely to a specific topic. Off-topic discussions or other means of communication are not allowed, subject to the sanctions set out in paragraph 3 below.
Gaijin’s Websites are post-moderated, so the information posted is not monitored or edited before publication, but the Administration reserves the right to do so later in any time, where, at the sole discretion of the Administration, it is necessary for compliance with these Guidelines, the Terms and Conditions, rules of law, Gaijin's obligations, or public order.
1.2. Community
The community of Gaijin’s Websites mainly comprise the following categories of its participants, having their respective roles as follows:

Administrators and Community Managers are the official Gaijin representatives, who are authorized to give the official responses on behalf of Gaijin. Administrators and the Community Managers may also perform the Forum moderation. The status of the Administrator and the Community Manager is indicated by the text below the profile picture.

Game Masters are individuals appointed by the Administration to help Users in the Games, as well as to make sure the Users follow the rules of the Games. Depending on the functionality of the specific Forum, the Game Masters may have the right to perform the moderation. The status of the Game Master is indicated by the text below the profile picture.

Moderators and/or Global Moderators are individuals appointed by the Administration to perform the moderation on Gaijin’s Websites. The Moderators and/or Global Moderators may perform the tasks of the Game Masters depending on the specific Gaijin’s Website. They have the right to edit, delete messages and close the Forum’s threads without explanation, as well as to perform other functions on community management.

Coordinators and/or National Coordinators are individuals appointed by the Administration of the project whose duties include overseeing gaming communities. The status of the Coordinator and the National Coordinator is indicated by the text below the profile picture.

Guests are the Forum visitors that did not complete the registration process. Guests have limited rights in most Forum sections and are not entitled to use most of the functionality of the Gaijin’s Websites.
Generally, the Community Managers, Moderators (and/or Global Moderators), Game Masters, Coordinators (and/or National Coordinators), as well as other persons managing the Gaijin’s Websites (collectively "Website Managers") are not employed by Gaijin and assist Administration voluntarily and free of charge.
The structure of the community and the competencies of its members may vary from one Gaijin’s Website to another.
1.3. Gaijin Account
Each registered User has a personal Gaijin Account with several mandatory parameters including but not limited to email, password, and nickname.
The owner of the Gaijin Account is solely responsible for the messages published on the Gaijin’s Websites from his Gaijin Account regardless of who was the real author of the message, unless the owner's non-involvement is directly and undoubtedly proven based on the corresponding evidence assessed and confirmed by Gaijin.
The Users who are not logged in under their Gaijin Account have the Guest status and are not allowed to post messages and do not have access to most of the Gaijin’s Websites’ functionality.
If the User loses his Gaijin Account as a result of hacking, he or she should immediately contact our customer support at support.gaijin.net.
2. GENERAL PROVISIONS
2.1. Registration on Gaijin’s Websites
To be eligible for registration on Gaijin’s Websites the User must meet the requirements set forth in Gaijin’s Terms of Service. Creating the valid Gaijin Account automatically creates an account on Gaijin's Websites.
To use Gaijin's Websites the User provides information necessary for the registration of Gaijin Account under Gaijin's Privacy Policy. Each User is allowed to have only one Gaijin Account and shall not create another Gaijin Account without the prior consent of the Administration.
By registering Gaijin Account to use a Gaijin’s Website, you agree that you will not:

Use Gaijin’s Websites to knowingly post false and/or abusive, obscene materials and/or any other materials that violate existing applicable laws, including but not limited to the posts containing confidential information or governmental secrets (as stated in the Military Restrictions Section).

Post any material protected by copyright, without the right holder's consent. In the case of publishing such copyrighted materials, you must identify authorship and the source of the materials.
-
Disclose the content of private messages with other Users as well as the content of official messages from Website Managers without the expressed permission of the corresponding User or Website Managers.
-
Impersonate other members of the community (especially the Administration and other Website Managers) in any way.
-
Contravene any other restrictions and prohibitions of these Guidelines
The Administration reserves the right to remove any materials that violate the above-mentioned requirements and apply appropriate sanctions to the Users who published them. Furthermore, the Administration reserves the right to remove in its sole discretion any material considered as objectionable.
2.2. Nicknames and avatars
It is forbidden to use the following words, images, and other content in your nickname, avatar (profile picture), or any other element of the User’s Gaijin Account details (email address, place of residence, etc.).

obscene or abusive images or language including words and consonants with the words and phrases in any language written, including transliteration;
-
images, words, phrases, and idioms that promote discrimination at all levels, including national, racial, ethnic, and sexual;
-
images, words, phrases, and idioms related to psychotropic or narcotic substances and their use;
-
images or nicknames, in whole or in part, are composed of copyrighted trademarks and names;
-
images or nicknames containing religious, racist, or Nazi symbols;
-
names connected with any historical or political personalities, including those judged by international courts for crimes against humanity, members of currently existing terrorist organizations, or groups that generally arouse feelings of suffering or disgust by the majority of people, etc;
-
nicknames that are misleading about their affiliation with the developers, Website Managers, and the Administration;
-
nicknames and avatars are judged to be insulting or inflammatory by the Administration or Website Managers;
-
combinations of unreadable signs;
-
insults, obscene or abusive words or images in any language;
-
content that contains pornographic material or is related to intimate types of the human body;
-
content that violates other provisions of these Guidelines.
The Administration and Website Managers reserve the right to unilaterally amend the User’s Gaijin Account details in case of such violation.
The restrictions and prohibitions of this paragraph apply to the images and media files (paragraph 2.5 hereof), as well as Users' signatures (paragraph 2.6 hereof).
2.3. Content of the User’s posts on Gaijin’s Websites
The official language of Gaijin’s Websites is English. The use of foreign languages, transliteration, and the deliberate distortion of the English language is not welcome (except in subsections for certain languages). For the avoidance of doubt, such restriction does not apply to the Gaijin's Websites dedicated entirely to a specific language.
The text of the message should be clearly readable, which means that Users shall not use pseudo-graphics, colored text markup, capital letters (Caps Lock), bold text, and font size change abuse.
The subject of the Forum’s thread (topic) must be informative and briefly display the content of such thread. It is forbidden to write the message text in capital letters (except for acronyms).
The Users are not permitted to use red color when drafting and designing posts and signatures on the Forum. The use of the red font is reserved for Administration and the Website Managers.
The Administration and the Website Managers have the right to remove a thread or a message, regardless of relevance, User's interest, and other factors. In such cases, the Administration and the Website Managers are not required to provide any additional comments regarding their actions.
2.4. Links
It is not forbidden to post links to the external resources in the posts on the Gaijin’s Websites. However, it is forbidden to place links to the pornography, descriptions of violent actions, information containing profanity or incitement to violence, promoting or offering the use of counterfeit products, and to any web resources that directly or indirectly violate international laws, applicable legislation, or Gaijin's Terms and Conditions (including these Guidelines). Advertising of any products, real and virtual, is also forbidden.
Users take full responsibility for the information contained in these external resources. Using such a link means you are leaving our Gaijin’s Website and we take no responsibility for and give no warranties, guarantees, or representations in respect of linked sites.
2.5. Images and media files
The Users are allowed to include the image in the message body. It is recommended to use the “hidden text” when posting a large number of images.
2.6. Signatures
The signature length is limited by the rules of the corresponding Gaijin Website. It is not recommended to abuse pseudo-graphics in signatures. Signatures may contain animations, but they should not irritate the eyes or make messages difficult to read.
It is prohibited to compose signatures with links to external resources other than Gaijin’s Websites without prior approval from the Administration. The number of the links in the signature shall not exceed two links.
The specific rules of the User’s signature regarding the relevant Gaijin’s Website are set out in the appendices hereto.
Signatures that do not meet these requirements will be deleted without warning.
2.7. Rating
Each User has a certain number of "rating points", for instance, a limited number of possibilities to react to the posts of other Users. Such a feature is determined by the functionality of the specific Gaijin’s Website and is specified in the appendices hereto.
2.8. Technical Section Rules
Sometimes, the technical Administrators may perform technical support regarding the Games in a relevant Forum section. The User should not post any content that is irrelevant to the bugs/suggestions/community technical support in such a section, subject to the sanctions specified in paragraph 3.6 of these Guidelines.
2.9. Attributes and symbols.
It is strictly forbidden to publish any texts, documents, images, recordings, videos, files, and other content which are in any way associated with:
-
organizations that violate or have violated international law (for example, the use of symbols, abbreviations and designations, acronyms, as well as names and surnames of Nazi leaders), including drawings and cartoons;
-
images and names of famous state, civilian and military leaders of the countries of the fascist / Nazi bloc;
-
images of awards of the countries of the fascist / Nazi bloc, part of which is the swastika and other signs prohibited by the applicable law;
-
the uniform of the armies of the Fascist / Nazi bloc, Nazi volumes of greetings, as well as portraits of criminals, convicted and not rehabilitated, including drawings and cartoons;
-
any other attributes/symbols of Nazi Germany and fascist Italy and other extremist or terrorist organizations;
-
banners, flags, badges, armbands, uniform attributes, greetings, passwords, musical works, as well as household items and other objects and objects representing themselves in any form of symbolism used by the National Socialist Labor Party of Germany and the Fascist Party of Italy, and any other extremist and nationalist organizations.
The Administration reserves the right to remove any of such content and impose the sanctions upon the Users according to paragraph 3.1 below.
2.10. User-Generated Content
2.10.1. The terms and conditions of these Guidelines apply to your posting and sharing as well as our use of any words, pictures, images, data, video, information or any other ‘user-generated content’ (“UGC”), that you upload, post, or share via Gaijin’s Websites.
2.10.2. The User hereby grants to Gaijin and its affiliates, agents, licensees, sublicensees, contractors, successors, legal representatives, assignees, and third-party service providers, and their respective partners, marketing and public relations agencies, affiliates a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable, sublicensable right and license to use UGC in any manner within the Forum, Gaijin Websites, and/or the Games, as well as in connection with them.
2.10.3. By Posting UGC, the User warrants that:

User will comply with any terms and conditions hereof as well as additional rules of the corresponding Gaijin’s Websites;
-
User owns the posted UGC or is duly authorized to post it and has the right, power, and authority to grant the rights set out in this paragraph to the Administration;
-
Gaijin is entitled to use UGC published by the User. In particular, Gaijin may lawfully permit other Users to view your UGC, without any payment (including any royalty payment to you or anyone else);
-
User obtained all consents and releases from all people who are identifiable in your UGC;
-
posted UGC is not confidential, does not infringe the intellectual property, privacy, or any other legal right of anyone else, and does not contain anything unlawful, abusive, libelous, defamatory, obscene, indecent, harassing, or threatening;
-
UGC does not contain a virus or other harmful component, or computer programming routine, software, file, or code designed to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information;
-
UGC does not interrupt, destroy, or limit the functionality of any Gaijin’s Websites or any computer software or equipment;
-
User does not disguise the origin of any UGC or impersonate any person or entity or misrepresent any affiliation with any person or entity, or store/collect other Users' personal data;
-
User hereby irrevocably grants Gaijin the right to use, cause and/or authorize using their UGC without attribution.
2.10.4. The User acknowledges that:
-
Gaijin’s Websites contain UGC submitted by Users over whom the Administration has no entire or overwhelming control;
-
it is not possible for the Administration to fully and effectively moderate, oversee or monitor the Gaijin’s Websites. In particular, to monitor whether any UGC infringes the copyright or any other legal right of a third party;
-
Gaijin does not undertake to permanently oversee, monitor, or pre-moderate any of Gaijin’s Websites and cannot, therefore, guarantee the accuracy, integrity, or quality of any particular UGC;
-
some Users may breach these Guidelines and post UGC that is misleading, untrue, or offensive. The User accepts all risks associated with his use of the Gaijin’s Websites and shall not rely on UGC in making (or refraining from making) any decision;
-
Gaijin is not liable to any of the Users in respect of any UGC you view on Gaijin’s Websites. Gaijin does not control or monitor all the UGC posted to Gaijin’s Websites by Users but reserves the right to do this (whether via moderation by the Website Managers or through technical methods) or to delete, move or edit any of your UGC without any notice to you. We may contact you by the provided email regarding your use of Gaijin's Websites.
2.10.5. If the User contravenes any of these rules, Gaijin reserves the right to suspend or permanently remove the availability of the User's UGC and to take any other steps considered appropriate.

ATTENTION! GAIJIN DOES NOT APPROVE OR ENDORSE THE USER-GENERATED CONTENT. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, GAIJIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS ARE NOT LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, PUNITIVE, OR SIMILAR DAMAGES ARISING OUT OF, OR RESULTING FROM, THESE UGC TERMS OF USE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR HARM TO BUSINESS, LOST PROFITS, LOST SAVINGS, OR LOST REVENUES, HOWEVER SUCH DAMAGES ARE CAUSED AND WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY OF LIABILITY. THE FOREGOING LIMITATIONS APPLY REGARDLESS OF WHETHER YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH INJURY, DAMAGES, LOSSES, OR EXPENSES.
2.11. No politics
Gaijin does not endorse or support any political parties, groups, movements, organizations or committees, any companies, partnerships, corporations, or associations organized or maintained for political purposes, as well as candidates for political office, including in connection with any election, referendum, proposed bill, or for any other political purpose whatever.
In connection therewith, Gaijin explicitly prohibits the use Gaijin’s Websites for political purposes, including the purposes above. The content of the User’s posts, as well as User's nickname, avatar and signature must not also contain any political symbols, logos, attributes, slogans, appeals, statements or other politically oriented content.
3. RESTRICTIONS AND SANCTIONS
The rules set out in this paragraph outline a general (illustrative) list of sanctions that may be imposed on the Users for violating these Guidelines. At sole discretion of the Administration or Website Managers, a lesser or more severe sanction may be imposed.
The Administration may decide to impose sanctions in case of both direct or indirect violations of these Guidelines, as well as in the situation when User’s actions do not formally fall under the restrictions, but generally contradict the principles established by the Guidelines.
Some of the Gaijin's Websites may establish specific rules regarding the punishment for violation of these Guidelines. In particular, the Administration and the Website Managers may establish different sanctions for the violations stated in paragraphs 3.1 — 3.15 hereof that apply to specific communities and sections of Gaijin's Websites or the Forums dedicated to the specific Game.
Most of the violations have a three-stage scheme of sanctions. For the fourth violation of a rule, the third-stage sanction or a more severe punishment may be imposed.
These Guidelines strictly prohibit the following:
3.1. It is forbidden to publish any texts, documents, images, recordings, videos, files, and other content which are in any way associated with:
3.1.1. Profanity, obscene and offensive language, words, phrases and abbreviations (including their disguised forms);
3.1.2. Insulting the Administration in person;
3.1.3. Insulting other members of the community;
3.1.4. Rudeness and vulgarity against them;
3.1.5. Psychotropic substances, drugs and alcohol propaganda;
3.1.6. Political and religious agitation and propaganda as well as propagation of conflicts. It is forbidden to discuss questions regarding actual political and religious issues because of the provocative nature of such discussion: it’s highly recommended not to draw comparisons between war-historical themes and any of the political events;
3.1.7. All manifestations of Nazism and racist statements as well as any Nazi symbols (as stated in paragraph 2.9 of these Guidelines);
3.1.8. Erotica and pornography, nudity exposion, photographs and images containing naked female genitals and breasts, male genitals, any other intimate parts of the human body.
The Gaijin Accounts of Users in violation of this rule are subject to the following sanctions:
1 violation — 3-days ban on the publication of threads and posts
2 violations — 7-days ban on the publication of threads and posts
3 violations — 30 days ban on the publication of threads and posts
3.2. Dissemination, distribution or other sharing of any real-life information about other Users, Website Managers, or Gaijin employees are not permitted (e.g. the real name, address, phone number). In addition, the publication of libel, other defamatory or false information is also prohibited. This restriction applies to public messages, personal messages, and complaints. In case of failure to comply with this rule the User’s Gaijin Account will be punished the following way:
1 violation — 3-days ban on the publication of threads and posts
2 violations — 7-days ban on the publication of threads and posts
3 violations — 30-days ban on the publication of threads and posts
3.3. All and any advertising, except personally agreed with the Administration of the corresponding Gaijin’s Website, is not allowed. Advertising is not permitted in, without limitation, signatures, on avatars, or in nicknames, as well as advertising spread with the help of the private messaging system. In addition, the Users are strictly prohibited from spamming on Gajin’s Websites.
All threads, messages, and records containing the advertisement may be deleted by the Administration and by Website Managers without notice. If the User materially violates this rule, the Administration or Website Managers may impose the following sanctions on the User’s Gaijin Account:
1 violation — 1-day ban on the publication of threads and posts
2 violations — 3-days ban on the publication of threads and posts
3 violations — 7-days ban on the publication of threads and posts
Users who repeatedly violate this rule will permanently lose their right to access the forum.
3.4. Duplicating messages in one or several threads or news sections and the creation of similar threads in different sections of the Forum (multi-posting) are forbidden. Before starting a new thread in the section, the User should use the search function of the Forum — it will help make sure that there is no existing similar thread. Topics and posts that duplicate other discussions may be closed and deleted without warning.
Creation of nonsensical posts (flood), including the posts unrelated to the thread's topic (off-topic), as well as abuse of emoticons and pictures are also prohibited.
Breaking the above-mentioned rules may result in sanctions or bans being applied to the User's Gaijin Account:
1 violation — 1-day ban on the publication of threads and posts
2 violations — 3-days ban on the publication of threads and posts
3 violations — 7-days ban on the publication of threads and posts
3.5. It is not allowed to post messages which are not related to the topic of the Forum or post messages in an inappropriate Forum section as well as messages which are unrelated to the Gaijin’s Website’s subject (for example unrelated to the news subject on the official "War Thunder" website). The exception to this rule is the information posted in Gaijin's Websites' sections intended for off-topic communication.
Topic titles should not be fully capitalized, and they must be a clear indication of the content of the post. It is further prohibited to abuse the "report" function as well as discuss unrelated topics (flood) in the "bug report" sections of Gaijin Websites (if any).
If you do not obey this rule, your Gaijin Account may be sanctioned as follows:
1 violation — 1-day ban on the publication of threads and posts
2 violations — 3-days ban on the publication of threads and posts
3 violations — 7-days ban on the publication of threads and posts
3.6. Alongside the rules of paragraph 3.5 above, reporting of game bugs, errors, or other flaws is not permitted other than in the Forum's section(-s) related to the technical support of the Games. Violating this rule is subject to the following sanctions:
1 violation — 1-day ban on the publication of threads and posts
2 violations — 3-days ban on the publication of threads and posts
3 violations — 7-days ban on the publication of threads and posts
3.7. Any information known to be false is restricted from being published, regardless of the degree of awareness of the author (especially concerning the publication of information on the development of Gaijin's game projects). Users in breach of this rule will be sanctioned as follows:
1 violation — 3-day ban on the publication of threads and posts
2 violations — 7-days ban on the publication of threads and posts
3 violations — 30-days ban on the publication of threads and posts
3.8. It is not allowed to discuss threads closed by the Administration or Website Managers as well as any Users’ posts deleted by them, challenge or discuss corresponding actions of Administration, Moderators (and/or Global Moderators), Community Managers, Coordinators, and Game Masters in any form. Depending on the circumstances and severity, the following sanctions may be imposed on the User’s Gaijin Account:
1 violation — 1-day ban on the publication of threads and posts
2 violations — 3-days ban on the publication of threads and posts
3 violations — 7-days ban on the publication of threads and posts
3.9. Users shall not discuss the ways to crack the protection of the Games, illegal ways to circumvent the security software of Gaijin (including forbidden modifications, hacks, exploits) or other ways to break the limitations set out in Gaijin EULA.
Publication of threads and messages that promote piracy and counterfeit products, as well as placement of links to online resources that offer pirated content is forbidden. It is restricted to discuss counterfeit or otherwise infringing software in any form. Violations of this rule may lead to Users being sanctioned temporarily or permanently, including the following sanctions:

3.10. Publishing messages proposing the sale/purchase of Gaijin Accounts or any in-game valuables, as well as any other messages calling for a violation of Gaijin Terms and Conditions should be regarded as breaching these Guidelines. The Gaijin Accounts of Users in violation of this rule are subject to the following sanctions:
1 violation — 7-days ban on the publication of threads and posts
2 violations — 30-days ban on the publication of threads and posts
3 violations — permanent account lockout
3.11. Users are not allowed to discuss the possibilities and methods of causing damage or losses to the Games, Administration, Website Managers, and other Users, including cheat programs, “bot” automation programs, ways to modify the client of the Games, vulnerabilities in the client and server parts of the Games, offering advantages in gameplay, and any other circumventing methods prohibited, directly or indirectly, by Gaijin EULA. The User may not encourage other Users to stop playing the Games or to avoid purchasing any content from the Gaijin.Net Store in any form; making or enforcing an ultimatum in connection with that is also prohibited. If this rule is broken, it may result in the following restrictions for the User’s Gaijin Account:

2 violations — 7-days ban on the publication of threads and posts
3 violations — 30-days ban on the publication of threads and posts
3.12. Registering and using backup accounts without prior authorization by the Administration is forbidden. In case of violation of this rule, the duplicate account will be removed, and the main one will be limited in its rights to access Gaijin’s Websites for 1 month.
3.13. Placing any information to gain access to accounts and personal data of Users is forbidden, as well as posing as Administration officer. In the event of such actions, the Administration reserves the right to terminate the offending account forever.
3.14. Full or partial publishing of private correspondence with the Administration, Website Managers, the support staff, and/or developers of the Games is not permitted. Violation of this rule may result in banning the offending Gaijin Account forever.
3.15. Dismissive attitude to the Game Rules, to the Gaijin's Websites, and the Gaijin's Terms and Conditions is banned. This prohibition applies both to public posts on the Gaijin’s Websites, and the messages sent through the service for personal messages and complaints.
All threads and posts that violate this rule may be deleted by the Administration and Website Managers without notice.
Inability to adhere to this rule may result in a temporary or permanent ban for the User's Gaijin Account:
1 violation — 7-days ban for publication of threads and posts;
2 violations — permanent ban.
4. LIMITATION OF LIABILITY
The User understands and agrees that he or she uses the Gaijin’s Websites at their own risk.
The Administration cannot be held liable for any of the content of any messages posted by Users (including but not limited to governmental secrets and confidential information as stated in the Military Restrictions Section to these Guidelines). The exclusive responsibility for the content of messages posted lies with the authors thereof.
The Administration does not guarantee that:

the Gaijin’s Websites will fully meet the Users’ requirements;
-
access to Gaijin's Websites will be provided in a continuous, quick, and reliable manner;
-
the information posted by Users on Gaijin's Websites is reliable.
5. MISCELLANEOUS
In all other aspects regarding the Websites use which are not specified by this Guidelines, including but not limited to governing law and jurisdiction, warranty disclaimer, indemnification, Guidelines update and modification, severability, assignment, and termination, the relevant provisions of Terms of Service shall apply to this Guidelines.

GAIJIN COMMUNITY GUIDELINES: RESTRICTIONS ON CLASSIFIED AND EXPORT-RESTRICTED INFORMATION (“Military Restrictions”)
IN BRIEF: you are not allowed to publish any Classified information and Export-restricted military-technical data other than Classified information, as well as some other defense information stated in paragraph 2 (iii) below (collectively “Restricted Information"). Some of the points below may help you to determine whether the information you intend to post on Gaijin's Website(-s) is permitted for distribution or not (nonetheless, please read these rules carefully and completely):
(i) If the information derives from the military-technical documents or materials produced earlier than 30 years from the date of prospective publication, and/or from any documents, files, content, or other medium containing a confidentiality (classification) brief, then such information is most likely to fall under the definition of the Classified information unless there is clear and convincing evidence on duly fulfilled public disclosure (declassification).
(ii) With no regard if the information to be published by you constitutes Classified information or not, you must refrain from disseminating any information which could be reasonably regarded as Export-restricted military-technical data.
The information which is not specified in subparagraphs a), b) and c) of paragraph 2(ii) is likely to be restricted unless either of the following applies:
-
you provide the source of such information, and that source belongs to one of the types listed in subparagraph d) of paragraph2(ii);
-
you have exercised due diligence (e.g. carefully checking the relevant documentation or other materials), and after that, you are not in the possession of any evidence that the information you are to publish is limited to distribution or other disclosure (for instance, usually the materials containing export-restricted data also contains relevant disclaimers or designations, or the restrictive character may directly lead from the context of such materials);

the information does not fall under the scope of the "military-technical data'' definition provided below; and/or
-
you provide other reasonable evidence that the information does not relate to Restricted Information.
For the purposes of this Military Restrictions Section, the "military-technical data" means any kind of information required for the design, development, production, manufacture, assembly, operation, repair, testing, maintenance, or modification of defense articles (military, vehicles, equipment, etc.), other than the Classified information as provided in paragraph2(i) below, information on unpublished military inventions and software specified in paragraph 2(iii) of these Guidelines. This data explicitly includes information in the form of blueprints, drawings, photographs, plans, instructions, or documentation.
1. General rule. The Users shall not contravene the applicable laws on state secrets (Russian Federation State Secrets Law as of July 21, 1993 No.5485-1, the Official Secrets Acts 1911-1989 in the UK, US President EO 13526 as of December 29, 2009, the interministerial General Instruction № 1300 in France etc.) or the export regulations (International Traffic in Arms Regulations in the USA, China’s Export Control Law, Russian Federal law “on state regulation of foreign economic activity” dated October 13, 1995 No. 157-FZ) by publishing any texts, documents, images, recordings, videos, files and other content which are (or relate to) military classified information, including any technical data, as well as any other types of government secrets or confidential information that are prohibited to disclosure, export or other distribution (“Restricted Information”), by virtue of a contract or law, in any of the countries of the world, and that have not been yet duly declassified or disclosed.
The User must consider these laws and regulations, and take all reasonable steps to ensure compliance with them. The User must be advised, unauthorized disclosure of the above-mentioned information may lead to criminal prosecution and responsibility.
2. Restricted Information. In particular, the following information shall be deemed Restricted Information as per these Guidelines:
i) Classified information. Documents with the corresponding level of classification (including but not limited to the "Secret", "Confidential", "Classified" designations) may be published only if they have been duly declassified. As a rule, such documents are declassified after a certain time, after which free and safe use is allowed. However, please pay special attention that the expiration of such a period does lead to instant and automatic declassification (e.g. without direct orders from the competent public authorities).
Under any circumstances, the Users are only allowed to publish technical documents on Gaijin's Website which have been produced at least 30 years before the date of the publication, unless otherwise provided by the applicable laws. Later produced documents are restricted for publishing on Gaijin's Websites if there is no clear and precise evidence on the declassification of such documents.
ii) Military-technical data. Users are prohibited from publishing or other distributing military-technical data, the disclosure of which is subject to export restrictions by the laws or regulations of any country.
The Users are allowed to publish information or content which are either of the following:
-
Common technical information (for example, general scientific, mathematical, or engineering principles commonly taught in schools, colleges, and universities).
-
Marketing information published by or on behalf of the manufacturer (including publicly available advertising brochures, information from the manufacturer's websites, other marketing announcements).
-
General system descriptions, including information on the basic functionality of a vehicle, weapon, or equipment derived from basic engineering principles and knowledge (e.g. the possibility to switch the range of the weapon's scope, the basic mechanics of the night-vision equipment, etc.).

Information or content that are based on, and cited with, the following sources:
-
websites of the manufacturer of military equipment/weapons (and other products);
-
official government websites and portals as well as other government sources (speeches, statements, letters, etc.) in relation to the document produced by this state;
-
public conferences, forums, exhibitions, etc.;
-
documents held in public national libraries;
-
literature legally sold or otherwise available to anyone;
-
legally published media materials;
-
official publications, including scientific publications.

Information or content which do not fall under the foregoing categories but cannot be reasonably considered as export-restricted military-technical data by virtue of applicable law.

Information that is otherwise is allowed under this Military Restrictions Section.
iii) Other export-restricted information. Users are also prohibited from any distribution of the following articles:

any kind of information on unpublished military inventions;

military software, including those intended for design, implementation, test, operation, diagnosis, and repair of military vehicles, equipment, or other defense articles;
-
any other article restricted to export or other distribution according to paragraph 2 of these Guidelines.
3. User’s obligations regarding Restricted Information. If the User publishes the documentation which may be reasonably deemed as Restricted Information according to this Military Restrictions Section, or have been earlier regarded as such, the User shall provide sufficient evidence that the information no longer falls within the scope of Restricted Information as defined above (e.g. a valid source from the list specified in paragraph 2(ii)(d) above, a statement on declassification, etc.), or otherwise prove the legality of their publication.
The Administration highly recommends specifying the source of each article published.
The User under no circumstances shall modify or change any of such technical documentation before the publication in order to misrepresent, deceive, or otherwise confuse the Administration and other Users regarding the classified or confidential status of such information (e.g. through painting over or deleting the classified brief, adding marks of declassification without proper authorization, and other changing documents, including with the use of specialized software).
The User shall exercise due diligence whenever dealing with military or governmental documentation and data on Gaijin's Websites. That includes checking the document for classification designations or unauthorized changes made for, without limitation, concealing the fact of classification (for instance, blurring or deleting confidentiality disclaimers).
NOTA BENE! If there reasonable grounds to believe that you failed to comply with the rules of this Military Restrictions Section, or your post otherwise contains Restricted Information or other content prohibited to distribution, the Administration, at its sole discretion, may remove your post, and in some cases - suspend your Gaijin account up to permanent ban (e.g. if repeated or severe violation(-s) have occurred).
GAIJIN COMMUNITY GUIDELINES: APPENDIX No.1 - FORUM.WARTHUNDER.COM SPECIFIC RULES
1. Specific rules regarding the community members and their competencies:

War Thunder Developers are representatives of Gaijin who assist the Administration and Website Managers in resolving issues concerning the technical aspects and the further development of the Game. Representatives of these groups have their status displayed below the avatar in the Forum’s profile.
-
There are several groups of Moderators (Technical Moderators, Forum's Moderators, Suggestion's Moderators, Senior Moderators, etc.). There are no Global Moderators on War Thunder Forum.
-
The Game Masters do not perform the moderation of the Forum. Their responsibility is limited to in-game supervision (for example, moderation of in-game chats and the monitoring of the players' behavior).
2. Specific rules regarding the technical functionality of the Forum:
-
Signature Size: The entirety of a User's signature must not exceed 200 px height 1000 px length and 150 kB in total size. Users are limited to the use of one image.
-
Reaction (rating) points: Each User has 15 reaction points (emojis). By using them User can "mark" a message of another User. Rank points are awarded to the User's account once a day.
3. Technical section rules. In addition to the forum rules above, the User shall not post:
-
incomplete bug reports (no files at all, only screenshot without any text with explanation);
-
FM/DM reports without any proof (i.e., reports where a User "feels" something is wrong: "I think/maybe/complaints about performance of tanks/planes" topics).
If there is a bug or issue it should have solid proof that it is a valid bug (i.e., historical proof regarding armor, bullet count, etc.). Such proof shall comply with the requirements of paragraph 2.10 ("User Generated Content") of these Guidelines and Military Restrictions Section ("Restrictions on the publication of classified and confidential information").
4. Status updates. In addition to the Guidelines, the User should pay particular attention to the following:

Status updates should be made in accordance with the Community Guidelines.
-
If the content of the User’s status will be in breach of these Guidelines, the functionality of such User’s account may be permanently revoked.
-
This is a two-strike system. The first strike will amount purely to an informal warning, with which the User will receive a PM explaining the situation. The second strike will amount to a permanent device on the User's status update abilities. A record of these warnings will be kept by the moderation team.
-
On occasion, an update will be removed without warning, this will not be counted in the two-strike total.
-
Appeals regarding this issue can be made to a Senior Forum Moderator via the Private Messages system, who may include other Senior Moderators to assess the situation. Appeal decisions are final.
5. Reporting. The User can report any violation of these Guidelines via the report button on individual posts and member profiles. Any other issues or more major issues can be done via a competent community member of War Thunder Forum (the list of them is available at forum.warthunder.com/index.php?/topic/48923-who-is-who-and-reporting-procedure. The User should require assistance from a specialist at the lowest level first. Any level jumping or ignoring the hierarchy will result in a delay in resolving the issue.
6. Sanctions. The Users of War Thunder Forum shall comply with all requirements of these Guidelines, including complying with restrictions stated in paragraph 3 hereof. However, the War Thunder Forum has its own penalties.
Penalties for the aforementioned offenses are divided into:

Informal ("Verbal") Warning - in the case of minor violation of the Guidelines, the User's post will be marked with a red note indicating which rule is broken, and an informal warning (without a penalty imposed) will be added to the User's warning list. In the case of continuously breaking these Guidelines by the User, this measure will have no place and will be replaced by "Formal Warning".

Formal ("Rule Breaking") Warning - in the case when a user is knowingly and intentionally violating the Guidelines, the User's post will be marked with a red note indicating which rule has been violated, and a warning with penalty points will appear on the User's warning list.
Every Formal Warning means one additional penalty point for the User's account. Each point(-s) increases punishment as listed below:

3 points: 7 days read-only

4 points: 14 days read-only

5 points: permanent read-only If a User gathers 5 penalty points (and thus receives 5 Formal Warnings), the Gaijin Account will be limited only to the ability to read the Forum without the option to take part in the discussion.
For the avoidance of doubt, none of the above shall deprive the War Thunder Forum's Administration and the Website Managers of the right to impose more severe penalties for the violations of the Guidelines.
The User has the right to appeal after punitive measures. Appeals can be made to a Senior Forum Moderator or Administration via the PM system, who may include other Senior Moderators or other Website Managers to assess the situation.
7. Posting limitations on certain websites. There are some limitations for posting comments to the news on warthunder.com (for instance, on https://warthunder.com/en/news). New User may only add comments after he or she plays at least 2 battles in the corresponding game. Furthermore, there is a rule of in-game activity:

3 battles played allow Users to post an unlimited amount of comments for a week;

15 battles played allow Users to post an unlimited amount of comments for a month;
-
If the User is not active in the corresponding game, he or she can’t post comments on the website.
COMMUNITY GUIDELINES: APPENDIX No.2 - FORUM.CROSSOUT.NET & FORUM.STAR-CONFLICT.COM SPECIFIC RULES

User’s signature. The following rules regarding the User's signature have been established:

The number of images: 2.

Image size: up to 350×150 pixels.

The image should be placed horizontally. It is prohibited to compose signatures with links to resources other than Gaijin’s Websites without prior approval from the Administration.

The number of links in the signature: no more than 2.

Rating. Each User has 6 rating points at his disposal: 3 positive and 3 negative. With their help, you can “mark” a message of another User. Rank points are awarded to your Gaijin Account once a day. This option may vary, subject to the rules established by the Administration and communicated via Forum.
COMMUNITY GUIDELINES: APPENDIX No.3 - ENLISTED-SANDBOX.GAIJIN.NET SPECIFIC RULES
1. Portal subject matter. Website http://enlisted-sandbox.gaijin.net/ ("Portal") is primary intended for discussion of Enlisted videogame, military history and military technologies. The Portal is also intended for the exchange of UGC designed for Enlisted videogame that is created by Users by means of the graphical editor or the CDK editor.
In particular, topics relating to the following subject areas are allowed on the Portal:

existing examples of armament or armament designs from any wartime periods;
-
distinguished historical figures, commanders and war heroes of the Second World War or other historical periods;
-
scientific and military designers somehow connected to the manufacturing of armaments;
-
art, both graphical (pictures, posters) and musical (marches, wartime music and folk songs);
-
historical photos and videos;
-
any other relating to Enlisted videogame, i.e., UGC, manuals, videos, humorous photographs and quotes, caricatures.
Gaijin reserves the right to delete any User’s posts and close the Forum’s threads in case of deviating from the Portal's subject matter.
2. Posting limitations. There are some limitations for creating publications and posting comments to publications on the Portal. New User may only create publications and post comments after he or she plays at least 10 (ten) battles in the Enlisted videogame.
3. Additional penalties. The Users of Portal shall comply with all requirements of these Guidelines, including complying with restrictions stated in paragraph 3 hereof. However, in addition to penalties set out in the Guidelines, Gaijin may impose the following sanctions regarding the use of the Portal:
